Zoetermeer grew fast from the 1970s, and many homes stand in terraces with matching rear facades and gardens. That is exactly where a rear extension and a dormer are often permit free. Around the old Dorpsstraat and in four other protected areas it is different. This page explains when an extension, dormer, roof window or internal renovation can be permit free, and how to check your own address.
- Nationally, a rear dormer (Bbl article 2.29(b)) and an extension in the rear yard (dowry articles 22.27 and 22.36) can be permit free under conditions.
- In Zoetermeer, plans that need a permit go to the city architect (stadsbouwmeester), who checks them against the Zoetermeer design guide and image quality plans.
- For small plans such as a dormer, canopy or window frame the city has short rules.
First: technical and planning rules
Under the Environment and Planning Act (Omgevingswet) every building plan has a technical part, checked against the Buildings Decree (Besluit bouwwerken leefomgeving, or Bbl), and a planning part, checked against the municipality's environment plan (omgevingsplan). Permit free does not mean rule free: the Bbl and the neighbour rules in the Civil Code always apply. This page explains how it works in Zoetermeer. It is not permit advice: only the online permit check or the municipality (gemeente) can confirm what applies to your address.
Extensions: the national rules
On the technical side, a side or rear extension is permit free if it stands on the ground, is no higher than 5 metres, has no habitable room on the second storey and no roof terrace or balcony (Bbl article 2.25).
On the planning side the dowry rules (bruidsschat) apply: national rules copied into every environment plan in 2024. The extension must be in the rear yard area, starting 1 metre behind the front facade, and more than 1 metre from public space (article 22.27). Within the article 22.36 limits below it can ignore the old zoning plan. Municipalities may change these rules.
| Situation | Condition |
|---|---|
| Within 4 m of the original house | At most 5 m high and at most 0.3 m above the first floor level |
| More than 4 m from the house | At most 3 m high, or a pitched roof with a ridge up to 5 m |
| Total area of annexes | At most half of a plot area up to 100 m², never more than 150 m² |
| Listed building or state protected area | Permit needed (article 22.28); in a protected area not in the yard behind the house, out of public view |
Dormers and roof windows
A dormer (dakkapel) is always permit free technically (Bbl article 2.27(2)(a)); a full roof extension is not. On the planning side, a dormer on the rear slope, or a side slope not facing public space, is free under Bbl article 2.29(b), which overrides the environment plan. The conditions are listed below.
At the front, a dormer is only free where no design requirements (welstand) apply (dowry article 22.27(c)). A roof window is free on the rear slope or a flat roof if it sticks out no more than 0.6 metres and stays 0.5 metres from the edges (Bbl article 2.29(c)). On a listed building, and in a state protected area on a slope facing public space, you need a permit (Bbl article 2.30).
- Flat roof.
- No higher than 1.75 m.
- Bottom more than 0.5 m and less than 1 m above the eaves.
- Top more than 0.5 m below the ridge.
- Sides more than 0.5 m from the edge of the roof slope.
Renovating inside the house
Internal work is permit free as long as the load bearing structure and fire compartments stay the same (Bbl article 2.27) and the building volume does not grow (dowry article 22.27(i)). A new bathroom or kitchen usually falls under this. If you remove a load bearing wall, IPLO, the government's information point for the Act, says you need a permit for the technical building activity. In a national monument (rijksmonument) even internal work often needs a monument permit. Normal maintenance stays free.
Tip from the trade: Have a structural engineer calculate a new steel beam before anything is demolished.
We zijn heel erg tevreden. Hele aardige man en echt vakwerk afgeleverd. Alles keurig netjes achtergelaten!
What Zoetermeer's environment plan adds
On its Dutch page Omgevingsvergunning Zoetermeer says you usually need a permit for building or demolition, for example for building work on a house, demolition in a protected townscape and work on a listed building. That 'usually' is about what falls outside the national exemptions. A rear dormer or extension that meets the national rules is not included.
If you want to know whether a plan is feasible, you can formally ask the city for advice in advance through a pre application consultation (vooroverleg), also in writing. If the plan looks feasible, you apply for the permit on the Omgevingsloket, or in writing by appointment at the city.
If your plan does not fit the environment plan, the city can only cooperate by making an exception. That can cause loss for neighbours, such as a fall in property value. In some cases Zoetermeer then asks for a planning damage agreement, in which you agree to cover that loss. For an ordinary extension within the rules this does not come up.
Design review, protected areas and listed buildings in Zoetermeer
When you apply for a permit, Zoetermeer puts your plan to the city architect. The city architect looks at how the building will look after the work, which materials you use and whether the plan fits its surroundings. The rules are in the Zoetermeer design guide (Welstandsnota) and image quality plans. For small renovations, such as a canopy, a changed facade or window frames, a dormer or a fence, there are short rules. Compare your plan with them before you apply.
Zoetermeer has five protected townscapes (Dutch), designated in February 2006 under the municipal heritage bylaw: the Dorpsstraat, the Meerpolder, the Voorweg, the Wilhelminapark and the Koepeltjesbuurt in Meerzicht. They are municipal designations. So the extra national rules for state protected areas in Bbl article 2.30 do not apply there, but the city protects them through its heritage bylaw and environment plan. Demolition there needs a permit.
The city has 15 national monuments, plus municipal monuments. The city's heritage map shows the plots and the listing description: the reason a building is protected. That description guides any decision on alterations, demolition or change of use.
Owners' associations and renting
A permit only means the government agrees. In a flat, the facade, roof and usually the load bearing walls belong to the owners' association (Vereniging van Eigenaren, or VvE). A dormer, extension or new opening then needs a VvE decision under the deed of division (splitsingsakte). The municipality does not check this.
If you rent, you need the landlord's consent for an extension, dormer, kitchen or bathroom. The landlord must reply within 8 weeks and may only refuse if the home becomes harder to let or loses value (Civil Code article 7:215).
How to check it yourself
Work through these steps in order for your own address. The national portal is in Dutch and you need DigiD to apply. Zoetermeer has no English building pages; the national government explains the system in English on Government.nl.
Questions can go to the city on 14 079. If you want to know what is possible structurally, contact us for a visit by Stas. For a full renovation we include the permit question in the planning.
- Run the permit check on the Omgevingsloket.
- Look up the rules for your plot in Rules on the map.
- Compare a small plan with the short rules on Bouw en verbouwing, welstand.
- Check the heritage page and the heritage map to see whether your address is in a protected townscape or listed.
- If in doubt, ask for a pre application consultation before you apply for the environment permit.
Frequently asked questions
Is a rear dormer in Zoetermeer permit free?
Yes, if it meets the five conditions of Bbl article 2.29(b) and the building is not listed. If it does not, you need a permit and the city architect reviews it.
My house is in the Koepeltjesbuurt. Do extra rules apply?
The Koepeltjesbuurt is one of the five municipally protected townscapes. Demolition needs a permit there, and plans that need a permit are subject to the heritage bylaw and the environment plan. Ask for your own address.
What does the city architect do?
The city architect assesses the appearance of a plan that needs a permit: how it looks, which materials you use and whether it fits its surroundings.
Can I apply on paper?
Yes. Zoetermeer lets you submit a written application by appointment. Online applications go through the Omgevingsloket.
