Utrecht explains on its own website, project by project, what is allowed. That is useful, but note: since 1 October 2026 temporary rules apply to dormers on side and rear slopes. This page explains when an extension, dormer, roof window or internal renovation can be permit free, what Utrecht adds, and how to check your own address.
- Nationally, a rear dormer (Bbl article 2.29(b)) and an extension in the rear yard (dowry articles 22.27 and 22.36) can be permit free under conditions.
- In Utrecht a front dormer always needs a permit, checked against the design criteria.
- Since 1 October 2026 temporary rules (a preparatory decision) apply to dormers on side and rear slopes.
First: technical and planning rules
Under the Environment and Planning Act (Omgevingswet) every building plan has a technical part, checked against the Buildings Decree (Besluit bouwwerken leefomgeving, or Bbl), and a planning part, checked against the municipality's environment plan (omgevingsplan). Permit free does not mean rule free: the Bbl and the neighbour rules in the Civil Code always apply. This page explains how it works in Utrecht. It is not permit advice: only the online permit check or the municipality (gemeente) can confirm what applies to your address.
Extensions: the national rules
On the technical side, a side or rear extension is permit free if it stands on the ground, is no higher than 5 metres, has no habitable room on the second storey and no roof terrace or balcony (Bbl article 2.25).
On the planning side the dowry rules (bruidsschat) apply: national rules copied into every environment plan in 2024. The extension must be in the rear yard area, starting 1 metre behind the front facade, and more than 1 metre from public space (article 22.27). Within the article 22.36 limits below it can ignore the old zoning plan. Municipalities may change these rules.
| Situation | Condition |
|---|---|
| Within 4 m of the original house | At most 5 m high and at most 0.3 m above the first floor level |
| More than 4 m from the house | At most 3 m high, or a pitched roof with a ridge up to 5 m |
| Total area of annexes | At most half of a plot area up to 100 m², never more than 150 m² |
| Listed building or state protected area | Permit needed (article 22.28); in a protected area not in the yard behind the house, out of public view |
Dormers and roof windows
A dormer (dakkapel) is always permit free technically (Bbl article 2.27(2)(a)); a full roof extension is not. On the planning side, a dormer on the rear slope, or a side slope not facing public space, is free under Bbl article 2.29(b), which overrides the environment plan. The conditions are listed below.
At the front, a dormer is only free where no design requirements (welstand) apply (dowry article 22.27(c)). A roof window is free on the rear slope or a flat roof if it sticks out no more than 0.6 metres and stays 0.5 metres from the edges (Bbl article 2.29(c)). On a listed building, and in a state protected area on a slope facing public space, you need a permit (Bbl article 2.30).
- Flat roof.
- No higher than 1.75 m.
- Bottom more than 0.5 m and less than 1 m above the eaves.
- Top more than 0.5 m below the ridge.
- Sides more than 0.5 m from the edge of the roof slope.
Renovating inside the house
Internal work is permit free as long as the load bearing structure and fire compartments stay the same (Bbl article 2.27) and the building volume does not grow (dowry article 22.27(i)). A new bathroom or kitchen usually falls under this. If you remove a load bearing wall, IPLO, the government's information point for the Act, says you need a permit for the technical building activity. In a national monument (rijksmonument) even internal work often needs a monument permit. Normal maintenance stays free.
Tip from the trade: Have a structural engineer calculate a new steel beam before anything is demolished.
Ze hebben in 1 week tijd de hele beneden verdieping stucwerk gerepareerd, geschilderd en gesausd tot volle tevredenheid. Netjes en accuraat gewerkt, flexibel geweest en vakwerk afgeleverd. Dus top.
What Utrecht's environment plan adds
On its Dutch page Dakkapel maken Utrecht says a front dormer always needs a permit, checked against the design criteria. For side and rear slopes the city lists the national conditions, plus two Utrecht points: the dormer does not sit above or below another dormer, and the building is not in a protected area and is not a (provisionally) listed building.
Since 1 October 2026 temporary rules apply in Utrecht to dormers on the side and rear of a home. The city council took a preparatory decision (voorbereidingsbesluit) for this. The city is drafting new rules and wants to prevent building in the meantime that would not fit them. According to the city, what this means depends on your situation. If you are planning a dormer, read the temporary rules or contact the city before you apply.
For an extension Utrecht refers to the permit check and the Bbl. Report the start of building work at least 3 working days before it begins. One more practical point: since 1 July 2026 Utrecht's electricity grid is full, and the grid operator Stedin cannot give you a new or heavier connection straight away. If your extension includes a heat pump or induction cooking, plan for that.
Design review, protected areas and listed buildings in Utrecht
Utrecht has six state protected townscapes (Dutch): the medieval centre, Blauwkapel, Oud-Zuilen, Haarzuilens, Utrecht-Oost with the Maliebaan, Wilhelminapark and the Veeartsenij site, and the garden villages Elinkwijk and De Lessepsbuurt. In 2013 the city itself designated the Minstroom area as a municipal protected area.
In a state protected area Bbl article 2.30 and dowry article 22.28 apply. According to the city, you need a permit sooner in these neighbourhoods, the environment plan fixes the size of buildings, and the design committee can set extra requirements for material and colour. A dormer on a listed building always needs a permit.
Utrecht checks design (welstand: whether a building looks right in its setting) against its design criteria and guidelines. They say, among other things, that a dormer must stay subordinate to the roof and should preferably match the dormers already in the block. For internal work the city's page on renovating inside applies: if you change the structure, involve a structural expert. Questions about listed buildings can go to [email protected].
Owners' associations and renting
A permit only means the government agrees. In a flat, the facade, roof and usually the load bearing walls belong to the owners' association (Vereniging van Eigenaren, or VvE). A dormer, extension or new opening then needs a VvE decision under the deed of division (splitsingsakte). The municipality does not check this.
If you rent, you need the landlord's consent for an extension, dormer, kitchen or bathroom. The landlord must reply within 8 weeks and may only refuse if the home becomes harder to let or loses value (Civil Code article 7:215).
How to check it yourself
Work through these steps in order for your own address. For a dormer, step 3 matters most right now. The national portal is in Dutch and you need DigiD to apply. The city's English pages cover registration and daily life, not building permits.
Questions can go to the city on 14 030. If you want to know what is possible structurally, contact us for a visit by Stas. For a full renovation we include the permit question in the planning.
- Run the permit check on the Omgevingsloket.
- Look up the rules for your plot in Rules on the map.
- For a dormer, read Dakkapel maken and the temporary rules linked there.
- Check the city page on protected areas and the national monuments register.
- Use the overview U wilt bouwen of verbouwen for other parts, such as a roof window or a new window in the facade.
